1. Introduction & Acceptance

By accessing or using the Device, App, or Platform, you agree to these Terms & Conditions (the "Terms"). If you do not agree, do not use the Services. These Terms form a binding agreement between you and Sunbots Innovations LLP, an Indian limited liability partnership registered in India with its principal place of business at 13 Hariharashray Bunglows, Thaltej, Ahmedabad 380059. Additional terms (e.g., specific plan terms, promotional offers, feature‑specific notices) may apply; in case of conflict, such specific terms prevail.

2. Eligibility & Accounts

You must be at least the age of majority in your state/UT (or have valid guardian consent) to create an account or purchase a Device. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any suspected unauthorized use.

3. Definitions

• Device: SMARTON smart glasses and any accessories provided by Sunbots.
• App: Official SMARTON applications for Android/iOS/desktop.
• Platform/Services: The App, website/portal, APIs, cloud features (e.g., Doc AI), and customer support.
• User Content: Content you submit or capture (e.g., images, audio, documents, queries).
• Online Mode vs Offline Mode: In Offline Mode, processing is performed locally on‑device to the extent technically feasible; in Online Mode, certain data may be transmitted to our servers or trusted processors to provide enhanced accuracy or features.

4. License & Acceptable Use

License: Subject to these Terms, Sunbots grants you a limited, non‑exclusive, non‑transferable, revocable license to use the App and firmware solely with the Device and for personal or authorized organizational use.

Restrictions: You shall not: (a) reverse engineer, decompile, or attempt to derive source code (except to the limited extent permitted by law); (b) circumvent technical protections or usage limits; (c) use the Services in violation of applicable law; (d) resell, rent, lease, or provide the Services to third parties except as expressly permitted; (e) upload malware; (f) interfere with or disrupt the Services; (g) use the Device while performing activities requiring full attention (e.g., driving) where unsafe or illegal; or (h) infringe intellectual property or privacy rights of others.

5. Health, Safety & No‑Medical‑Advice

SMARTON is an assistive technology intended to improve accessibility; it is not a medical device and does not provide medical advice, diagnosis, or treatment. AI outputs, scene descriptions, object/currency detection, OCR readings, and Doc AI summaries may be inaccurate or incomplete. Always verify critical information and exercise personal judgment. Follow safety instructions and local regulations. Do not rely on the Device in hazardous environments or where failures could cause injury.

6. Plans, Subscriptions & Billing

Plans: We may offer plans that include Offline‑only features, and Premium plans with Online features (e.g., Doc AI page allowances). Plan inclusions and quotas are described at purchase and may evolve to improve service quality.

Auto‑renewal: Subscriptions auto‑renew at the end of each billing cycle unless cancelled prior to renewal. You can cancel within the App/account settings per Section 2.4 of the Refund & Cancellation Policy.

Fees & Taxes: Prices include applicable taxes where stated. You authorize our payment processor to charge your selected method for recurring fees. No refunds for subscriptions as detailed in the Refund & Cancellation Policy.

7. Disclaimers & Limitation of Liability

Disclaimers: The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Sunbots disclaims all warranties (express or implied), including merchantability, fitness for a particular purpose, accuracy, non‑infringement, and uninterrupted availability.

Limitation: To the maximum extent permitted by law, Sunbots is not liable for (a) indirect, incidental, special, consequential, exemplary, or punitive damages, or (b) loss of profits, data, goodwill, or business interruption, even if advised of the possibility. Our aggregate liability for all claims under these Terms shall not exceed the amounts you paid to Sunbots for the Services in the 12 months preceding the claim (or ₹10,000, whichever is lower).

8. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to applicable consumer law, courts in Ahmedabad, Gujarat shall have exclusive jurisdiction.

9. Changes to Terms

We may update these Terms to reflect changes in law or our Services. Material changes will be notified via the App/website or email, and will become effective when posted unless otherwise required by law.
